Terms of Service

1. Acceptance of Terms

By accessing or using geta.work ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

geta.work is a software-as-a-service (SaaS) platform designed for freelancers. The Service monitors Upwork job postings based on user-defined filters and delivers real-time notifications via Telegram. Additional features include AI-powered cover letter generation, advanced job filtering, and subscription management. The Service is provided on an "as is" and "as available" basis.

3. Account Registration

To use the Service, you must create an account by providing a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Providing accurate and up-to-date information.
  • Notifying us immediately of any unauthorized use of your account at support@geta.work.

Authentication is managed through Supabase Auth. We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions and Payments

The Service offers both free and paid subscription plans. By subscribing to a paid plan, you agree to the following:

  • Billing: all payments are processed securely through Stripe. You authorize Stripe to charge your selected payment method on a recurring basis according to your chosen plan.
  • Pricing: subscription prices are displayed on the Service at the time of purchase. We reserve the right to change pricing with 30 days advance notice.
  • Renewals: subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
  • Cancellation: you may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
  • Free trial: new users may be eligible for a free trial period. At the end of the trial, you will need to subscribe to a paid plan to continue using premium features.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Service to violate any applicable laws or regulations.
  • Attempt to gain unauthorized access to the Service, other user accounts, or related systems.
  • Use automated tools, bots, or scripts to access the Service in a manner that exceeds normal usage patterns.
  • Resell, redistribute, or sublicense access to the Service without our written consent.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to send spam, unsolicited messages, or misleading proposals on any platform.

6. Telegram Integration

The Service integrates with Telegram to deliver job notifications. By connecting your Telegram account, you acknowledge that: (a) your Telegram user ID and chat ID will be stored in our database to facilitate message delivery; (b) notifications are sent through the Telegram Bot API and are subject to Telegram's terms of service and availability; (c) we are not responsible for delays or failures in message delivery caused by Telegram's infrastructure; (d) you may disconnect your Telegram account at any time through your account settings.

7. AI-Generated Content

The Service provides AI-generated cover letters as a convenience feature. You acknowledge that: (a) AI-generated content is provided as a starting point and should be reviewed and edited before submission; (b) we do not guarantee the accuracy, quality, or effectiveness of AI-generated content; (c) you are solely responsible for any content you submit to clients or platforms using the Service; (d) AI-generated content may not always reflect your personal style or meet specific job requirements.

8. Intellectual Property

The Service, including its design, code, features, and branding, is the intellectual property of geta.work and is protected by applicable copyright and trademark laws. You retain ownership of any content you create using the Service, including customized cover letters and filter configurations. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Your data is stored using Supabase with encryption and row-level security. Payment data is processed by Stripe and is not stored on our servers. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses or damages resulting from service interruptions, including missed job notifications or delayed alerts.

11. Limitation of Liability

To the maximum extent permitted by applicable law, geta.work and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements, that job data will be complete or accurate, or that notifications will be delivered without delay.

13. Third-Party Platforms

The Service interacts with third-party platforms including Upwork, Telegram, and Stripe. We are not affiliated with, endorsed by, or responsible for the policies, terms, or actions of these platforms. Your use of third-party platforms is governed by their respective terms of service. Changes to third-party APIs or policies may affect the functionality of the Service, and we are not liable for such changes.

14. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting support@geta.work.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
